HB 651 (Persons-Mulicka) would allow parents to file civil lawsuits seeking monetary damages for mental and emotional pain and suffering and for medical or funeral expenses when the death of their unborn child is caused by intentional acts or negligence. By adding "the parents of an unborn child" to the list of people who are defined as "survivors" for the purposes of filing a wrongful-death lawsuit, the measure advances recognition of the legal status of the unborn. The bill clarifies that such wrongful death action may not arise against the mother for the wrongful death of her own unborn child. The FCCB indicated its support for the measure in a meeting of the House Civil Justice Subcommittee, which passed the bill 12-5. The Senate Companion, SB 476 (Grall), waits to be heard in its first committee.
